Divorce

While divorce is never easy, some divorces are more complicated and emotionally taxing than others.

Grounds for Divorce
The Maryland legal system recognizes two types of grounds for divorce, which are "no fault" and "fault" grounds.

No Fault
In a "no fault" divorce, the couple may obtain a divorce if they have been:

  • Mutually and voluntarily separated for one year continuously and without interruption, and there is no expectation or hope of reconciliation.
  • If the couple has been separated continuously and without interruption for two years, regardless of whether the separation was initially mutual and voluntary.

Fault
If a divorce is filed on grounds of fault, the most common grounds include one or more of the following:

  1. Cruel treatment of a spouse or a minor child
  2. Excessively vicious treatment of a spouse or a minor child
  3. Adultery
  4. Desertion
